White House in Contempt

Dear Dwight,

I wanted to take the opportunity to update you on the status of the contempt of Congress resolution in the House of Representatives.

As you may know, the Judiciary Committee passed a resolution before the August recess holding the White House and Harriet Miers in contempt of Congress for their failure to provide documents and appear before the committee as legally required by subpoena.

The information we have received to date from the Justice Department from our U.S. Attorneys investigation indicates the White House played a central role in the firing of the nine federal prosecutors. Yet, the White House has stonewalled and consistently refused to cooperate with inquiries into this matter.

At the heart of our investigation is the evidence uncovered suggesting that the nine U.S. Attorneys were fired for politically-motivated reasons, while others may have been retained because they were pursuing partisan investigations.

We have also discovered that job candidates' political contributions and affiliations were considered in hiring decisions for nonpartisan positions in the Department of Justice. Our job has been made more difficult by apparent misleading testimony from the Attorney General and other Department of Justice officials.

This politicization of our judicial system cannot be tolerated. Our citizens have a right to expect that federal prosecutions will be conducted in a fair

The 10 major causes of failure in leadership

We come now to the major faults of leaders who fail, because it is just as essential to know WHAT NOT TO DO as it is to know what to do.

1. INABILITY TO ORGANIZE DETAILS.

Efficient leadership calls for ability to organize and to master details. No genuine leader is ever "too busy" to do anything which may be required of him in his capacity as leader. When a man, whether he is a leader or follower, admits that he is "too busy" to change his plans, or to give attention to any emergency, he admits his inefficiency. 2. UNWILLINGNESS TO RENDER HUMBLE SERVICE.

Truly great leaders are willing, when occasion demands, to perform any sort of labor which they would ask another to perform. "The greatest among ye shall be
the servant of all" is a truth which all able leaders observe and respect.

3. EXPECTATION OF PAY FOR WHAT THEY "KNOW" INSTEAD OF WHAT THEY DO WITH THAT WHICH THEY KNOW.

Dear Friends:

We continue to await a decision from the U.S. Court of Appeals for
the Third Circuit, Philadelphia, concerning my client, Mumia Abu-
Jamal. This complex case was orally argued before a three-judge
panel on May 17, 2007, following extensive litigation which included
voluminous briefing and motions. In my experience of successfully
defending a large number of murder cases involving the death penalty,
it was a great day.

It is impossible to know what the federal court ruling will be. If
the judges follow the law and fairly apply the U.S. Constitution, we
will win. As to when, long ago I projected a decision would be
forthcoming this fall; it could come any day. One thing is certain:
whomever loses will seek a rehearing and petition the U.S. Supreme
Court.

I have previously described the different rulings that the federal
court could make. Nevertheless some people have recently sent out e-
mail containing false information. Contrary to their claim, the
federal court cannot impose a sentence of "life in prison without
parole". Only a jury verdict could result in such an outcome, unless
in the event of a penalty reversal the prosecution elected not to
seek the death penalty.
